ATLAS TRADE TOOLS PURCHASE IS REQUIRED TO ENTER THE DRAW.

This sweepstakes (the “Sweepstakes”) is organised and administered Atlas Trade of 8 Hautu Drive, Wiri, Auckland, Auckland, 2104, New Zealand (“Atlas”).

  1. Eligibility: The Sweepstakes is open only to entrants who:
  • sign up at the online sweepstakes page www.atlastrade.co.nz and
  • are at least 13+ years old at the time of entry; and
  • are legal residents of New Zealand at the time of entrance.

If you are under 18 years old, you must have the permission of a parent or legal guardian to enter the Sweepstakes. By entering the Sweepstakes, you confirm that your parent or guardian has also read and accepted these Terms.

Employees of Kiwicare Holdings their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those domiciled with them are not eligible to participate in the Sweepstakes.

  1. Agreement to these Terms and Conditions: these terms and conditions (“Terms”) govern your participation in the Sweepstakes By entering the Sweepstakes, you will be deemed to have accepted these Terms, and you represent and warrant that you meet the eligibility requirements set out in clause 1 above. In addition, you agree to accept the decisions of Atlas Trade, as final and binding as it relates to the content. No correspondence or appeals will be entered into The Sweepstakes is subject to all applicable laws.

  2. Sweepstakes Period: Entries will be accepted online starting on March 1 2024 at 12:01 AM and ending March 31 2024 at 11:59 PM (“Entry Period”). Entries received outside the Entry Period will be ineligible for the Sweepstakes. All times are (GMT+12:00) Auckland. 

  3. How to Enter: The Sweepstakes must be entered by submitting an entry using the online form provided on this site, during the Entry Period. The entry must fulfil all sweepstakes requirements, as specified www.atlastrade.co.nz/pages/level-up-to-legendary-promo, to be eligible to win a prize. Entries that are not complete or do not adhere to these Terms or specifications may be disqualified at the sole discretion of Atlas Trade. . You may not enter more times than indicated using the same receipt number by using multiple e-mail addresses, identities or devices in an attempt to circumvent these Terms. If you use fraudulent methods or otherwise attempt to circumvent these Terms your submission may be deemed ineligible at the sole discretion of Atlas Trade.
  4. Prizes: The prizes for the Sweepstakes are as follows:
  • 1 x $5,000 cash prize
  • Your entrance into the Sweepstakes does not guarantee you will win a prize. Your chance of winning is dependent on the total number of eligible entries received. Actual/appraised value of the prizes (as indicated above) may differ at time of prize award. The specifics of the prize shall be solely determined by Atlas. No cash or other prize substitution permitted except at Atlas’ discretion. Prizes are not transferable or exchangeable. Any and all prize related expenses, including without limitation any and all taxes shall be the sole responsibility of the winner. Acceptance of a prize constitutes permission for Atlas Trade to use winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
  1. Winner selection and notification: Winners of the Sweepstakes will be selected in a random drawing under the supervision of Atlas. Winners will be notified via e-mail to the e-mail address they entered the Sweepstakes with within five (5) days following the winner selection. Atlas shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 15 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, prize may be forfeited and an alternate winner selected. The receipt by winner of the prize offered in this Sweepstakes is conditioned upon compliance with all applicable laws and regulations. ANY VIOLATION OF THESE TERMS BY ANY WINNER (AT ATLAS’ SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

  2. Rights Granted by you: By entering this Sweepstakes you understand that Atlas, will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, in New Zealand in any media now known or hereafter, for six (6) months after the Entry Period , your entry, including, without limitation, the winner's name, , voice, image or statements about the Sweepstakes, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

  3. Terms: Atlas reserves the right to cancel, terminate, modify or suspend the Sweepstakes should a virus, bugs, non-authorised human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Atlas may select the recipients from all entries received prior to and/or after (if appropriate) the action taken by Atlas. Atlas reserves the right to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes, website or violates these Terms, or where such individual is engaged in any unlawful or other improper misconduct intended to jeopardise the fair and proper conduct of the Sweepstakes, or that may cause reputational damage to Atlas. Failure by Atlas to enforce any of its rights does not constitute a waiver of those rights.

Atlas has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void votes for any reason, including, but not limited to;

  • multiple entries from the same user from different IP addresses;
  • multiple entries from the same computer in excess of that allowed by these Terms; or
  • the use of bots, macros or scripts or other technical means for entering.

Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, Atlas reserves the right to seek damages from any such person to the fullest extent permitted by law.

  1. Limitation of Liability: Except for liability that may not be excluded by law, Atlas shall not be liable under or in connection with these Terms, the Sweepstakes and/or giving the prizes for any cost, expense, loss or damage suffered by an entrant, even if such cost, expense, loss or damage was reasonably foreseeable, and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise and whether direct, direct or consequential in nature.

  2. Privacy Policy: Any personal information submitted with an entry and collected by Atlas as part of the Sweepstakes will be collected, stored and used in accordance with these Terms, Atlas’ Privacy Policy, (available at https://atlas-trade-nz.myshopify.com/pages/privacy-policy) and the Privacy Act 2020.

  3. Winners List: For the names of the winners, please contact us at contact@atlastrade.co.nz and in the body of the email type 'Please e-mail me the winners' list for the Atlas Trade Sweepstakes.

  4. This Sweepstakes may be promoted through third party websites, like Facebook, Twitter, Youtube, Pinterest, LinkedIn and Google. Entrants must at all times comply with the terms of service for those third-party websites when using them to participate in this Sweepstakes. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, those third-party websites.

  5. These Terms shall be governed by the laws of New Zealand and any dispute shall be subject to the exclusive jurisdiction of the New Zealand courts.
